Chapter 2 Terms of Coaching Section 1 Introduction Welcome to Parenting Absolute (“Company”, "coach", “we”, “our”, “us”)! These Terms of Service (“Terms”, “Terms of Coaching”) govern your use of our website located at parentingabsolute.com (together or individually “Service”) operated by Parenting Absolute. Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them. If you do not agree with (or cannot comply with) Agreements, then you may not use the Service. These Terms apply to all visitors, users, and others who wish to access or use Service. Section 2 Coaching Service does not provide legal or financial advice or make guarantees and promises. By taking part of any Service, you are bound by the following clauses: Clause 2.1 You agree to be punctual for, and present during every consultation scheduled. Clause 2.1.1 We shall terminate the consultation without prior notice or liability in the event that the User has not been present, as agreed, for longer than a third of the agreed-upon duration. Clause 2.1.2 The User may appeal to the Company to reschedule the consultation within 24 of termination. Clause 2.2 You agree to take full responsibility for all actions taken by you as a result of using Service. You cannot hold the Company responsible for any action taken by you that is not part of Service. Clause 2.2.1 You are liable to any personal information disclosed to the coach during the session. Any actions taken by the coach outside of the session shall be considered to be taken at their own discretion. Clause 2.3 You understand and agree that you are fully responsible for your physical, mental and emotional well-being during each consultation. Clause 2.4 You agree to be completely transparent and truthful to the coach about every element related to your case. Clause 2.5 You agree to not use Service as a substitute for professional advice by legal, medical, financial, business or other qualified professionals. Section 3 Reminders The Company shall not communicate reminders beyond 24 hours prior to the commencement of Service. Section 4 Privacy Policy Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. If you are located outside India and choose to provide information to us, please note that we transfer the data, including Personal Data, to India and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. Parenting Absolute will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information. Section 6 Fee Changes Parenting Absolute, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Parenting Absolute will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount. Section 7 Prohibited Uses You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service: Clause 7.1 To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation. Clause 7.2 For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise. Clause 7.3 To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity. Clause 7.4 In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. Clause 7.5 Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent. Clause 7.6 Use any device, software, or routine that interferes with the proper working of Service. Clause 7.7 Attack Service via a denial-of-service attack or a distributed denial-of-service attack. Clause 7.8 Take any action that may damage or falsify Company rating. Clause 7.9 Otherwise attempt to interfere with the proper working of Service. Section 8 Prohibition Of Use By Minors Without Parental Consent Service is intended only for access and use by individuals at least eighteen (18) years old. By accessing or using Service, you warrant and represent that you are at least eighteen (18) years of age and with the full authority, right, and capacity to enter into this agreement and abide by all of the terms and conditions of Terms. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK. NEITHER COMPANY NOR ANY PERSON ASSOCIATED WITH COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.
